NEW PROPERTY BILL APPROVED IN PARLEMENT ON 4 DECEMBER 2018

IMPORTANT NEWS FOR BUYERS, SELLERS & ESTATE AGENTS !!

 

A new Bill with huge implications for buyers, sellers and estate agents, the Property Practitioners Bill, was passed in Parliament on 4 December 2018. This bill provides greater consumer protection and closes the gap in providing protection to buyers of second-hand homes which The Consumer Protection Act failed to address.

Sellers of a property will now need to declare all defects (Latent and Patent) on their property. Unhappy or disgruntled buyers can now approach a new Ombud to rectify damages and seek compensation. 

Previously Buyers had to follow an expensive legal process to fight their case after signing the “Voetstoots (As is)” clause and discovering defects. In most of the cases most of the Buyers would just have to accept the defects because the costs were simply too expensive and beyond many of the Buyers means, having just committed a major financial obligation to the purchase. This expensive and onerous step has now been removed and Buyers can register valid complaints with the Ombud for a decision.

 

The new Bill has a huge impact on the industry because now, for the 1st time, the power position has transferred from the Seller to the Buyer, creating a much more equal position on the market.

Sellers can now be held responsible for ALL defects (Latent & Patent), regardless of whether the Seller was/was not, aware of the defect.

 

Agents will be better served by getting ALL defects declared upfront to minimise delays in registering properties and dealing with comebacks after the deal was concluded.

 

Sellers are strongly advised to protect themselves. The best way to do this is by commissioning an independent JJE Property Inspection.

 

JJE Property Inspections offer property inspections suited for BUYERS, SELLERS & LESSORS as well as the compilation of a 10yr Maintenance Plan for Sectional Title Complexes as required by the Sectional Title Act.

 

The Agent's role now needs to change to that of a negotiator to deal with the actual condition of the home.

 

In JJE Property Inspections’s view, this is a new way of building bridges of trust between Buyers, Sellers and Agents. It is fairer and morally more acceptable. In todays’ world it isn’t acceptable that one party (Buyer) is at a disadvantage to a property transaction and we welcome the new legislation.

The Property Practitioners Bill have not been published yet. It still has to be passed by the National Council of Provinces which will probably take place before next years’ elections. All that then remains is for the State President to sign the Act for it to be applicable. In terms of the Act, the minister has powers to promulgate further regulations setting out how it may be implemented. These regulations often give the act teeth or substance to the Act, much like they do to the Sectional Title Schemes Management Act. In essence, Buyers, Sellers, and Agents now have to be more careful about property transactions.     2. Partial Inspections

      1. External Only - Same as Comprehensive inspection, excluding inside of residence

      2. Roof Only - ​Inside of roof cavity and rooftop

  2. Progressive Inspection - Monitor building process during erection of new buildings or additions to existing buildings

  1. Vital Inspection - Covers Vital areas of concern eg: Those issues which are likely to lead to major damage or a safety risk in the near future, and which are likely to materially affect the safety, functionality or structure of the installation or area

  1. Rental Inspection

Similar to Comprehensive inspection, but primary focus on details inside property. Carried out before tenant moves in, when tenant moves out and at intervals as required by landlord

Informative JJE Property Inspections reports usually save clients many times our fee. (Our fees are based on the number of rooms in the house – bedrooms, bathrooms, living rooms, kitchen, garage, and outbuildings.)

  1. We deliver the JJE Property Inspections report within two working days of the inspection.

  2. Our home inspection condition reports are comprehensive and cover all areas of the house – including the roof, roof cavity, geyser, walls, foundations, floors, ceilings, and finishes.

  3. JJE Property Inspections reports are of a high professional standard and will include the following aspects:

    1. General overview of the property inspected

    2. List of all serious/potentially serious problems noted during the non-invasive inspection

    3. Suggestions on how best to address the serious/potentially serious problems noted during the non-invasive inspection

    4. Estimated Cost analysis to address the serious/potentially serious problems noted during the non-invasive inspection

  4. At an additional fee, JJE Property Inspections will carry out a follow-up inspection upon request, to ensure the problems identified was addressed satisfactory.

SELLERS

VITAL INSPECTION REPORT – LIMITED SCOPE FOR SELLERS

Only “Vital Areas of Concern” are mentioned in JJE Property Inspections’s VITAL reports.

VITAL, in JJE Property Inspection reports means “A Safety, Functional or Structural issue which, in our opinion, requires immediate corrective action to ensure the essential safety, functional or structural integrity of the property or major installation in question.

Vital areas of concern are those issues which are likely to lead to major damage or a safety risk in the near future, and which are likely to materially affect the safety, functionality or structure of the installation or area. These issues are frequently NOT obvious to any observant layman after carefully viewing the property.

Examples of VITAL areas of concern includes Structural cracks, Measured active damp, roof leaks, illegal or unsafe geyser and electrical/gas installations.

 

VITAL REPORT:

The VITAL report is popular among estate agents and property sellers and is offered by JJE Property Inspections as IPCA (Independent Property Condition Assessment).

Sellers and Agents are encouraged to use VITAL as a more reliable alternative to the usual “Sellers Condition Declaration”, which the Estate Agency Affairs Board requires sellers to complete.

Partial Inspections - External Only: R900

  1. Outside of Pretoria Metro area, add R2.50/Km travelled, plus toll fees if applicable.

  2. If overnight is required, add Accommodation fees and subsistence fees of R200/day

  3. Follow-up inspections charged at R300/inspection, including the above if applicable
